EU Anti-Deforestation Regulation Effectively 'Watered Down' Despite Initial Fanfare
Originally hailed as a pioneering law that would curb the worldwide crisis of deforestation.
However, the revised version of the EU's anti-deforestation law, once touted as the crown jewel of the European Green Deal, has emerged in a significantly diluted state, prompting criticism from its original architect and environmental politicians.
"The regulation was hollowed out," said Hugo Schally, citing the exclusion of key obligations for later-stage companies to verify the provenance of products like palm oil, soy, wood, beef, rubber, cocoa and coffee.
Schally cautioned that a reduced number of responsible companies, less information collected, and less precise origin data would make enforcement and prosecution more difficult.
A Watered-Down Law
Environmental vice-president a leading green politician was more blunt, labeling the postponements, exceptions and new loopholes – such as one for printed products – as the "systematic weakening" of the law.
This final text is a far cry from the demands of more than a million EU citizens who supported an initiative in 2020 demanding a ban on goods linked to forest destruction.
When launched in 2021, then-Green Deal commissioner the European commissioner trumpeted it as "the toughest legislation ever put forward to combat deforestation."
A Story of Dilution
The law's unravelling has been interpreted as the EU walking back its green talk. The proposal encountered two major postponements, reportedly over technical problems, which sparked criticism.
"By reopening this file instead of solving a simple IT problem, authorities invited political interference," commented Toussaint.
Originally, the regulation required companies to track goods back to their specific geographic origin using GPS coordinates, holding them accountable for forest loss along their supply lines with criminal charges and hefty fines.
"This was not red tape for its own sake," the former official explained. "It was the mechanism that ensured enforcement, created a verifiable paper trail, and prevented firms from obscuring their activities behind opaque production networks."
Mounting Pressure
However, the strict due diligence triggered a backlash in the EU capital from large companies, exporting nations, rightwing parties and member states with forestry industries.
Experts cite last year's EU elections as a decisive moment, creating a new political majority more skeptical of green regulations.
"The other pressure came from big trading partners like the United States," noted expert Andreas Rasche, implying the commission gave in to some demands in trade talks.
The Weakened Final Text
The passed law includes key dilutions:
- Downstream operators were mostly exempted from submitting due diligence statements.
- A new “low risk” category was introduced.
- A window for further "simplifications" was established for next spring.
- Only four countries – Russia, Belarus, North Korea and Myanmar – will face “high risk” scrutiny.
"Instead of tightening rules for companies, it rolled them back," lamented Schally. "By shifting responsibilities to producers, it lessened the number of responsible firms."
Uncertainty for Companies
The protracted process and revisions have also created annoyance for companies that prepared in advance.
"It is very frustrating because we put a lot of effort into preparing," said a coffee company executive. "We invested in software, followed seminars and built a team... now they’re saying it may be changed. It’s a major letdown."
Official Defense
A commission spokesperson supported the final law, saying: "We have listened to concerns and acted to ensure a pragmatic and balanced implementation."
