Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Detention

A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks legal authority.

"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge stated in her ruling.

The situation originates in a erroneous removal to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to answer alien smuggling charges, he was held in federal custody.

In her decision, the court pointed out that the authorities does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

The court proceedings center on conflicting claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this claim.
